InstaGen AI provides AI-powered image generation services. Users can upload reference images and generate AI-created images based on their specifications. The Service operates on a credit-based system where users purchase credits to generate images.

3. Credits and Payments

Credits are purchased through our platform and are used to generate images. Each generation consumes credits as specified at the time of purchase. Credits are non-transferable and have no cash value.

All sales are final. Credits cannot be refunded or exchanged for cash under any circumstances.

4. Generation Quality and Consistency

You acknowledge and agree that AI-generated images are inherently variable in nature. Due to the nature of AI image generation technology, individual generated images may vary in quality, style, appearance, and consistency with other generations or reference images.

No Refunds for Generation Variations: InstaGen AI is not liable for, and will not provide refunds or credit compensation for, any generated images that do not match your expectations, differ from other generations, or vary from reference images provided. This includes but is not limited to:

• Images that appear different from previous generations
• Images that do not perfectly match reference photos
• Variations in facial features, body proportions, or other characteristics
• Differences in lighting, style, or artistic interpretation
• Any inconsistencies between generated images

By using the Service, you accept the inherent variability of AI-generated content and acknowledge that each credit spent represents a generation attempt, not a guaranteed specific result.

5. User Content and Uploads

You retain ownership of any images you upload to the Service. However, by uploading content, you grant InstaGen AI a limited license to process your images for the purpose of providing the Service.

You represent and warrant that you have the right to upload any images you submit and that such images do not violate any third-party rights.

6. Generated Content Rights

Subject to these Terms, you are granted a license to use images generated through the Service for personal and commercial purposes.

InstaGen AI reserves the right to use successfully generated images (without personally identifiable user information) for the purposes of improving our AI models, training future generation systems, and enhancing the quality of our Service. See our Privacy Policy for more details.

7. Prohibited Uses

You agree not to use the Service to:

• Generate illegal, harmful, or offensive content
• Create images of real individuals without their consent
• Produce content that infringes on intellectual property rights
• Generate deepfakes or deceptive media intended to mislead
• Create content depicting minors in any inappropriate context
• Violate any applicable laws or regulations

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTAGEN AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to InstaGen AI in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED IMAGES WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated terms on our website. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
